INFORMATION ON THE PROCESSING OF PERSONAL DATA

In this Information on the processing of personal data, we, Feichtinger Žídek Fyrbach advokáti s.r.o., with registered office at Česká 154/12, Brno-město, 602 00 Brno, ID No.: 29304873, a company registered in the Commercial Register maintained by the Regional Court in Brno under file No. C 72824, provide you with information on how we, as the data controller, process your personal data.

We always process your personal data in accordance with the Regulation No. 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, General Data Protection Regulation (hereinafter referred to as the "Regulation"), Act No. 85/1996 Coll., on advocacy and related legal and professional regulations. 



  1. WHEN DO WE PROCESS YOUR PERSONAL DATA?

    1. When we are providing legal services to you

We process your following personal data when providing legal services:

  • Identification and contact data, in particular name and surname, ID number, VAT number, e-mail address, telephone number, transaction data such as account number, etc.

  • Other personal data you provide us in connection with the provision of legal services.

The provision of this personal data is voluntary. However, if you do not permit us to process this personal data, we may not be able to provide you with legal services.

In this case, we will process your personal data for the purposes of fulfilling the contract or for the implementation of measures taken prior to the conclusion of the contract at your request within the meaning of Article 6(1)(b) of the Regulation. We will process the personal data for this purpose for the duration of the performance of the contract (or the negotiation thereof) and for as long as we are required to do so by law (generally five years from the date of termination of the provision of legal services).

We may also process your personal data on the grounds of our legitimate interests within the meaning of Article 6(1)(f) of the Regulation with regard to the establishment, exercise, or defense of our legal claims related to the provision of legal services or for the purpose of sending commercial and related marketing communications (e.g. newsletters) by electronic means under the conditions provided for by law. We will process personal data for this purpose for as long as necessary to protect our legitimate interests.

  1. When you contact us via the contact form

If you contact us via the contact form on our website, we will process your following personal data:

  • Identification and contact details, in particular name, e-mail address, and telephone number

  • Where applicable, any other personal data you provide in the contact form 

Filling in the contact form is voluntary. However, unless you do so, it will not be possible to contact us via this method.

In this case, we will process your personal data for the following purposes: 

  • Responding to your message sent via the contact form, for which we have a legitimate interest within the meaning of Article 6(1)(f) of the Regulation. We will process your personal data for this purpose for the time necessary to reply to your message.

  • Concluding a contract if your message has been sent for the purpose of concluding a contract for the provision of legal services. The legal basis for the processing is the implementation of measures taken prior to the conclusion of the contract at your request within the meaning of Article 6(1)(b) of the Regulation. We will process personal data for this purpose for the duration of the contract negotiations. You can read more about the processing of your personal data with regard to the provision of legal services on the basis of a contract in section A.1.

  • If you give us your consent, we will further process your personal data in our database of potential clients. In this case, we may send you commercial and related marketing communications (e.g. newsletters) by electronic means. The legal basis for processing in this case will be your consent within the meaning of Article 6(1)(a) of the Regulation. Consent is given voluntarily. We will process personal data on the basis of your consent for as long as you have given your consent. You may withdraw your consent at any time (see section D below) without prejudice to the lawfulness of the processing carried out prior to withdrawal.

  • We may also process your personal data on the grounds of our legitimate interests within the meaning of Article 6(1)(f) of the Regulation in connection with the establishment, exercise, or defense of our legal claims related to the response to your report. We will process personal data for this purpose for as long as is necessary to protect our legitimate interests.

  1. When you visit our website

To make our website clear and easy to use for you, we process cookies. Cookies are text files containing small amounts of information that are stored on the device from which you access our website when you visit it. Cookies are useful to us because they provide us with valuable information to improve our website. 

On our website, we use:

  • Functional cookies, which are necessary to ensure the basic functions of our website. Due to their nature and purpose, functional cookies are enabled and cannot be disabled. The legal basis for processing is our legitimate interest within the meaning of Article 6(1)(f) of the Regulation. We will process personal data for this purpose for the duration of the Regulation.

  • Analytical cookies to help us improve and streamline the functionality of our website by tracking your activities on it. Analytical cookies, for example, count traffic to our website and, by collecting anonymous statistical data, enable us to better understand your behaviour on our website. This enables us to continuously improve our website.  

  • Marketing cookies, which collect information to better tailor any advertising to your interests, both on and off our website.

We can only use analytical and marketing cookies if you give us your consent to do so within the meaning of Article 6(1)(a) of the Regulation via the cookie bar on our website. Giving consent is voluntary. We will process personal data on the basis of your consent for as long as you have given your consent. You may withdraw your consent at any time via the cookie bar without prejudice to the lawfulness of the processing carried out prior to withdrawal. 

  1. When we comply with our obligations under the AML regulations

In the cases referred to in Section 2(1)(g) of Act No. 253/2008 Coll., on Certain Measures to Combat the Legalization of the Proceeds from Crime and the Financing of Terrorism (hereinafter referred to as the "AML Act"), we, as an obliged person, are obliged to carry out the statutory measures in the area of combating the legalization of the proceeds from crime and the financing of terrorism, in particular to conduct client identifications and checks.

In connection with the performance of our obligations under the AML Act, we are obliged to process your following personal data: 

  • If you are a natural person, we may process all your first and last names, birth number or, if birth number is not assigned, date of birth and gender, as well as place of birth, permanent or other residence, and nationality. 

  • If you are a natural person in business, we may also process your business name, distinctive supplement or other designation, registered office, and identification number. 

  • We may also process information beyond the above, such as a telephone number, bank account number, the purpose of the transaction being monitored, documentation of the transaction or source of funds, etc.

The provision of personal data is a legal requirement under the AML Act. Compliance with the obligations under the AML Act is carried out, inter alia, by providing the necessary documents or papers. We may make copies or extracts of these documents or papers for the purposes of the AML Act and further process the data thus obtained for the purposes of the AML Act.

We will process your personal data for the purposes of fulfilling our legal obligations in the field of combating the laundering of the proceeds of crime and the financing of terrorism, which we are obliged to do within the meaning of Article 6(1)(c) or (e) of the Regulation. We will retain your personal data for a period of ten years after the transaction outside the business relationship or the termination of the business relationship with you.

  1. When you apply for employment with us

If you apply for employment with us, we will process in particular your following personal data:

  • Identification and contact data, in particular name and surname, e-mail address, telephone

  • Data on your professional qualifications (education, knowledge and skills, previous work experience, etc.)

  • Where applicable, other personal data you provide in connection with your application for employment

The provision of this personal data is voluntary. The legal basis for processing in this case will be our legitimate interest within the meaning of Article 6(1)(f) of the Regulation. We will generally process personal data for this purpose for the duration of the selection procedure.

  1. WHO ARE THE RECIPIENTS OF YOUR PERSONAL DATA?

We will process your personal data ourselves or through trusted processors (providers of information systems and software or similar services, cooperating lawyers, tax advisors, etc.). We may also disclose your personal data to persons who have a lawful reason to do so, as well as to other persons, if this is necessary to comply with our legal obligations or to protect our rights.

We do not intend to transfer your personal data to a third country outside the EU or to an international organization. Exceptionally, however, this may happen (e.g. if the processor has its servers located outside the EU). In such a case, the transfer will only take place if there is a decision of the European Commission in respect of the selected third country, in which it 2has been found that this third country ensures an adequate level of protection of personal data, or if the selected processor is able to provide appropriate organizational and technical safeguards, in particular through standard contractual clauses on data protection adopted by the European Commission, and there is enforceability of your rights and effective legal protection in the country of this processor.

  1. WHAT RIGHTS DO YOU HAVE UNDER THE REGULATION?

As a data subject, you have all the rights under the Regulation, in particular:

  • The right to obtain confirmation from us as to whether or not your personal data is being processed and, if so, the right to access that personal data and the other information referred to in Article 15 of the Regulation 

  • The right to request the rectification of inaccurate data pursuant to Article 16 of the Regulation and the right to erasure of personal data where one of the grounds set out in Article 17 of the Regulation applies 

  • The right to request that we restrict processing if one of the cases referred to in Article 18 of the Regulation occurs 

  • The right to obtain personal data in a structured, commonly used and machine-readable format and the right to transmit such data to another controller pursuant to Article 20 of the Regulation without hindrance

  • The right to object to the processing of personal data based on our legitimate interest within the meaning of Article 21 of the Regulation 

  • The right to lodge a complaint with a supervisory authority if you believe that the processing of your personal data violates the Regulation; in the Czech Republic, the supervisory authority is the Office for Personal Data Protection, located at Pplk. Sochor 27, 170 00 Prague 7.
